PROVISION OF DIGITALLY AMENDABLE INFORMATION BY Vision 1 Architects

Information Disclaimer and Architects Indemnity Agreement

    Conditions for the use of digitally amendable information provided by Vision 1 Architects. Notwithstanding any occurrence whatsoever, by the act of opening this or these files, the recipient of any digitally amendable information from Vision 1 Architects unconditionally agrees as follows:
  • Vision 1 Architects may, at its sole discretion, allow import by others, of it’s digitally amendable drawings under the conditions outlined herein.
  • Digitally amendable drawings are only available to the Architect co-ordinated project team or other parties agreed in writing by Vision 1 Architects.
  • Digitally amendable drawings are only available to the recipient via email in zip files or on FTP site.
  • Vision 1 Architects does not warrant the drawing content of any of its digitally amendable drawings to any recipient.

The recipient agrees that:

  • The digital data will not be used by any person or consultant to copy for set out purposes.
  • The recipient is responsible for checking all information contained in Vision 1 Architects digitally amendable drawings and verifying correctness of information.
  • The digitally amendable drawings are for “information only” and hard copies take precedence. The contract in which we collectively are involved, will be a hard copy contract.
  • The digitally amendable drawings are to be used only for this project on this site.
  • The digitally amendable drawings are to be used only by the organisation or person identified by Vision 1 Architects as the bona fide recipient.
  • No recipient shall send electronically any digitally amendable drawings which contain Vision 1 Architects digital information, to any third party external to the Architect co-ordinated project team without Vision 1 Architects prior written consent.
  • Where such consent is provided such third party shall agree to use the Vision 1 Architects digitally amendable information strictly in accordance with this agreement. The party supplying information to the third party shall be responsible to ensure such agreement.
  • All information contained in the digitally amendable drawings transmission is owned by the originator and is not to be amended or used for other purposes.
  • The recipient indemnifies the architect from any failure by the recipient to observe any or all of these conditions.
  • “Digitally amendable” is defined as any amendable format including but not limited to .dwg, .rvt files. The following file formats may be sent as required; .pdf (preferred)
  • All members of the Architect co-ordinated project team and all persons who or organisations which procure Vision 1 Architects digitally amendable data must be prepared to provide to Vision 1 Architects amendable file digital drawings derived from digital data information provided by Vision 1 Architects .
  • With the exception of distribution for co-ordination purposes, Vision 1 will observe conditions on digitally amendable drawings received as has been requested from others in this agreement.
